The Case
A 6-year-old child with a disability, who is cared for by a PCA at home, was found to have bruises on their arms in a pattern resembling hand marks. The child’s parents suspected physical abuse and sought legal counsel. The legal team engaged our services to investigate the child’s medical history and the PCA’s background to determine the likely cause of the bruising.
Our Approach
Our legal nurse consulting team carefully examined the child’s medical records, focusing on any pre-existing conditions that could contribute to easy bruising or bleeding. We also investigated the PCA’s professional background and any history of abuse charges.
Through our thorough analysis, we discovered that the child had been diagnosed with a rare bleeding disorder, which was clearly documented in their medical records. However, we also found that the parents had not informed the PCA of this condition before the care took place.
Objectives
We sought to answer the following key questions:
- Does the child have a documented medical condition that makes them more susceptible to bruising or bleeding?
- Does the PCA have a history of professional misconduct or abuse allegations?
- If the child has a relevant medical condition, did the PCA take appropriate precautions and communicate any incidents of bruising to the parents?
The Outcome
Our findings indicated that while the child’s bruising was likely related to their underlying medical condition, the PCA was not made aware of this condition and therefore could not take appropriate precautions. We also found no evidence of prior misconduct or abuse allegations against the PCA. Our report provided valuable context for the legal team, helping them to guide the parents towards better communication with caregivers and to avoid unfounded accusations of abuse.
