The Case
A 52-year-old male driver fell asleep while driving on a residential street, resulting in the death of a pedestrian. The legal team representing the driver contacted our legal nurse consulting firm to investigate the driver’s medical history and determine if any underlying conditions could have contributed to the accident.
Our Approach
Our team of legal nurse consultants thoroughly reviewed the driver’s medical records, focusing on identifying any pre-existing conditions that may have caused him to fall asleep while driving.
Through our meticulous analysis of the driver’s medical history, we discovered that he had been diagnosed with obstructive sleep apnea (OSA) three years prior to the accident. However, we also found evidence that the driver was not consistently using his prescribed continuous positive airway pressure (CPAP) machine to manage his condition.
Objectives
We sought to answer the following key questions:
- Does the driver have an underlying condition that might have caused him to fall asleep?
- If a medical condition exists, has it been formally diagnosed, and is the driver aware of it?
- If the driver has a diagnosed condition, is he taking appropriate steps to manage and treat it? Did he make responsible decisions about driving considering this condition?
The Outcome

Based on our findings, we concluded that while the driver had a diagnosed medical condition that could have contributed to falling asleep at the wheel, he was not taking adequate steps to manage his condition as prescribed by his physician. Our report provided crucial evidence for the legal team to demonstrate that the driver’s negligence in managing his sleep apnea played a significant role in the tragic accident.
